Payment during Force Majeure. The Contractor shall not be entitled to any payment in respect of any period where the Work is not carried out as a result of Force Majeure. Except grant of time extension, in no event whatsoever, the Contractor shall be entitled for any other cost(s) including, prolongation costs, expenses, or site establishment charges or the like.

Payment during Force Majeure. The Department's obligation to pay the Capacity Payment will not be excused on account of an event of Force Majeure to the extent that the Seller is capable of providing the Rated Capacity or Energy. If the Seller is unable to provide all or part of the Rated Capacity and Energy as a result of a Force Majeure, the Department shall pay the Capacity Payment only to the extent that the Seller is providing the Rated Capacity and Energy on a pro-rata basis.
